📄 Terms and Conditions of Sale

1. Introduction

These Terms and Conditions of Sale govern the purchase of products from Ottica Carraro (referred to as “we,” “us,” or “our”) through our website at www.otticacarraro.it (the “Website”). By placing an order for products, you agree to be bound by these Terms and Conditions.

2. Orders and Acceptance

  1. Order Placement: All orders are requests to purchase a product. The order is placed when you complete the checkout process on our Website.
  2. Order Acceptance: We will send you an Order Confirmation email upon receipt of your order. This email does not constitute our acceptance of your order. Acceptance of the order and the formation of the contract of sale occurs only when we send you a second email confirming that the goods have been shipped (“Shipping Confirmation”).
  3. Refusal of Order: We reserve the right to refuse any order you place with us. This may be due to, but is not limited to, the product being out of stock, failure to authorise payment, or suspicion of fraudulent activity.

3. Pricing and Payment

  1. Pricing: All prices are as specified on the Website at the time you place your order but exclusive of delivery charges, which will be added to the total amount due during the checkout process.
  2. Payment: We accept payment via Visa, Mastercard and American Express. Payment must be received in full before products are dispatched.
  3. Price Errors: If we discover an error in the price of any products you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it.

4. Shipping and Delivery

  1. Shipping Costs: shipping costs are calculated based on the destination of your order and are clearly displayed at checkout.
  2. Delivery Times: We aim to dispatch all orders within 5 working days. Delivery estimates are provided for guidance only and are not guaranteed. We are not responsible for delays outside our control.
  3. Estimated TIME OF DELIVERY and COST

  5. Usa, Canada: 5 – 7  days Euro 25,00
  6. Oceania  5 – 7 days Euro 30,00
  7. Risk of Loss: Risk of loss and damage passes to you upon delivery of the product.
  8. Handling, packaging, soft or hard case and a special micro fiber cleaning cloth ARE INCLUDED  in the cost of the spectacles.

5. Import Duties, Taxes, and Customs Clearance (International Orders)

  1. Customer Responsibility: Orders shipped outside of our operating region (e.g., to the United States and the United Kingdom) may be subject to import duties, customs duties, taxes, and brokerage fees. These charges are levied once the shipment reaches your destination country.
  2. Payment of Charges: These additional charges are the sole responsibility of the recipient (the Customer). We have no control over these charges and cannot predict what they may be. We are not responsible for any delays or issues caused by the recipient’s failure to pay these charges promptly.
  3. Consequences of Non-Payment and Abandonment: If the recipient refuses to pay the import duties, taxes, or brokerage fees, the package may be considered abandoned by the Customs authority. In the event the shipment is abandoned due to the recipient’s refusal to pay duties and taxes, the order will not be eligible for a refund or reshipment, and this will not be a ground for dispute or chargeback.

6. Returns, Refunds, and Cancellation

  1. Right of Withdrawal (EU Consumers): If you are contracting as an EU consumer, you have the right to withdraw from this contract within 14 calendar days without giving any reason.
  2. Returns Policy (General): Products must be returned unused, in their original packaging, and in resalable condition. You are responsible for the cost of returning the goods.
  3. Refunds (General): We will process the refund due to you as soon as possible and, in any case, within 14 days of the day we receive the returned goods.
  4. International Returns (USA and UK Exclusion):
    • Products shipped internationally (including to the United States and the United Kingdom) cannot be returned for a refund if the return is complicated by, rejected by, or generates excessive cost due to local customs processes, import taxes, or duties imposed by the destination country upon re-entry.
    • In case of a voluntary return, the customer is fully responsible for ensuring the goods clear customs on their return journey and for covering all associated fees, duties, and taxes charged by our country’s customs for the return.
    • We reserve the right to refuse any returned package if we are asked to pay import duties, handling fees, or taxes upon its arrival back in our country. If a return is refused due to the non-payment of these fees by the customer/shipper, the order will not be eligible for a refund.
  5. Cancellations: Orders may only be cancelled prior to receiving the Shipping Confirmation email.

7. Product Information and Warranty

  1. Product Descriptions: We take all reasonable care to ensure that all details, descriptions, and prices of products appearing on the Website are correct. However, we do not warrant that the product descriptions are fully accurate, complete, reliable, current, or error-free.
  2. Warranty: All products sold come with a legal warranty of conformity.

8. Intellectual Property

The content of the Website, including text, graphics, logos, images, and software, is the property of Ottica Carraro and is protected by intellectual property laws.

9. Liability

To the maximum extent permitted by law, we exclude all liability for any loss or damage of any kind howsoever arising, including without limitation any direct, indirect, or consequential loss whether or not caused by our negligence.

10. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Italy. You agree that the courts of  Italy Venice will have non-exclusive jurisdiction to resolve any dispute arising from these Terms and Conditions.
